Appointment of correspondents
The approval process of correspondents serves to ensure a comprehensive and mutual exchange of information in international relations. It guarantees that approvals are granted consistently throughout the entire International Motor Insurance Card system and that claims are forwarded to the correspondents responsible as quickly as possible.
Art. 4 et seq. of the Internal Regulations (agreement between insurance bureaux) and Annex II of the NBI & NGF Claims Regulations set out the conditions for the approval of the initial appointment of correspondents in Switzerland and abroad.
The procedure is initiated by a request submitted by an insurer to the insurance bureau in its own country of membership. The insurance bureau forwards the application to the corresponding foreign insurance bureau and confirms that the appointed correspondent accepts the nomination. The nomination must be confirmed or rejected within three months. The insurance bureau that has received the application will check whether the conditions for approval have been met:
For correspondents in Switzerland
- Has the designated correspondent signed the Swiss Interclaims Agreement?
- Was the foreign insurance company already represented in Switzerland by another correspondent? Was this correspondent fully compensated for his activities and have any outstanding amounts been settled?
- Are companies active in one or more EEA states with freedom to provide services and freedom of establishment? Have these companies appointed one and the same correspondent in Switzerland both for their head office and for their activities in these states?
For correspondents abroad
- Does the designated correspondent comply with the applicable national regulations?
- Was the Swiss insurance company already represented by another correspondent in the country concerned? Has the correspondent been fully compensated for his activities and have any outstanding amounts been settled?
- Are Swiss companies active in one or more EEA states with freedom of establishment? Have these companies appointed one and the same correspondent both for their head office and for their activities in other states on their own territory?
If all conditions are met, the nomination is approved. If no response is received within three months of receipt of the application, approval is deemed to have been granted implicitly.
