Selon la loi sur la circulation routi\u00e8re (LCR), le BNA et le FNG sont financ\u00e9s par une contribution annuelle qui est vers\u00e9e par les d\u00e9tenteurs de v\u00e9hicules \u00e0 moteur. Les assureurs responsabilit\u00e9 civile pour v\u00e9hicules automobiles per\u00e7oivent cette contribution en m\u00eame temps que la prime. Le montant des contributions est fix\u00e9 par le BNA et le FNG. L’autorit\u00e9 f\u00e9d\u00e9rale de surveillance des march\u00e9s financiers FINMA doit donner son approbation (art. 76a LCR).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

Principe du calcul des contributions<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

L\u2019ordonnance sur l\u2019assurance des v\u00e9hicules (OAV) d\u00e9finit les principes suivants du calcul et de la supervision du paiement des contributions. Le BNA et le FNG calculent le montant des contributions des d\u00e9tenteurs de v\u00e9hicules automobiles selon les r\u00e8gles reconnues de la technique de l\u2019assurance (art. 58 OAV).<\/p>

Les compagnies d\u2019assurances informent les assur\u00e9s sur le montant des contributions (art. 59 al. 1 OAV) et fournissent (art. 59 al. 2 lit. b OAV), ainsi que l\u2019OFROU et la FINMA (art. 59a OAV), au NVB et NGF les informations n\u00e9cessaires pour la supervision de la collecte correcte des contributions par les compagnies d\u2019assurances.<\/p>

L’Ordonnance concernant les exigences techniques requises pour les v\u00e9hicules routiers (OETV) d\u00e9finit les motocycles (art. 14 OETV), les v\u00e9hicules automobiles l\u00e9gers (art. 10 al. 2 1\u00e8re phrase OETV), ainsi que les v\u00e9hicules automobiles lourds (art. 10 al. 2 2\u00e8me phrase OETV).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

La conf\u00e9d\u00e9ration ainsi que ses entreprises et instituts sont lib\u00e9r\u00e9s de l\u2019obligation de payer les contributions. Les cantons comme d\u00e9tenteurs de v\u00e9hicules automobiles pour lesquels l\u2019assurance responsabilit\u00e9 civile n\u2019est pas obligatoire (art. 73 al. 1 LCR) sont oblig\u00e9s \u00e0 payer les contributions dans la mesure o\u00f9 leurs v\u00e9hicules sont assur\u00e9s (art. 76a al. 4 LCR).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t
